These Terms of Service ("Terms") govern your use of the CloPinz mobile application, website, and related services (the "Services") operated by JosJov Inc. d/b/a CloPinz ("CloPinz"). By accessing or using the Services you agree to these Terms.
You must be at least 13 years old to use the Services and 18 years old to purchase subscriptions or conduct paid transactions. If under the age of majority in your jurisdiction, you may only use the Services with parental or guardian consent.
You agree to provide accurate registration information, maintain the security of your login credentials, and accept responsibility for all activity under your account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
CloPinz may offer subscription tiers including:
Subscriptions may be offered monthly or annually and automatically renew unless canceled prior to the renewal date.
By purchasing a subscription you authorize CloPinz to charge your payment method on a recurring basis until you cancel.

Payments are processed through third-party providers including but not limited to Stripe, Apple, and Google. CloPinz does not store full payment card information. Unless required by law, subscription fees already paid are non-refundable. CloPinz may change pricing or subscription features with reasonable notice.
CloPinz grants users a limited, non-exclusive, non-transferable, revocable license to use the Services for personal or organizational golf contest purposes.

Subscriptions are intended for use by the subscribing individual or organization. Organizations such as golf courses may use the Services within their facility for tournament or contest administration.
Accounts may not be shared across multiple businesses, facilities, or organizations unless expressly authorized by CloPinz. Unauthorized sharing of accounts or attempts to bypass subscription requirements may result in suspension or termination.
CloPinz provides tools intended solely for recreational golf contests and informal competitions. The Services are not an official scoring authority and should not be relied upon as the sole determinant of contest outcomes.
Measurements and leaderboard rankings may be inaccurate due to:
CloPinz makes no guarantee regarding the accuracy or availability of measurements or rankings.
Golf courses, tournament directors, and contest organizers retain full authority to determine official contest rules, measurements, winners, and contest outcomes. Any measurements, distances, rankings, or leaderboards displayed within CloPinz are informational only.
The golf course or tournament organizer always has final authority in determining official contest results regardless of any data displayed within the CloPinz Services.
CloPinz does not resolve disputes between players, golf courses, tournament directors, or contest organizers regarding contest outcomes or measurements. Participants agree that reliance on CloPinz measurements is at their own risk.
CloPinz does not administer prize funds and is not responsible for prize distribution, contest outcomes, or contest eligibility.
Golf involves inherent risks including swinging clubs, moving golf carts, uneven terrain, and outdoor hazards. Use of a mobile device may increase risk of distraction. Users should remain aware of their surroundings and should not use the Services while swinging a golf club, operating a golf cart, or in hazardous situations.
By participating in contests you acknowledge that your name, username, scores, rankings, and leaderboard positions may be publicly displayed including:
By using the Services you grant CloPinz, JosJov Inc., participating golf courses, and tournament organizers the right to use your name, username, contest participation, leaderboard rankings, and related information in promotional materials including social media, event recaps, advertising, and promotional communications without compensation.
Golf courses that create an account, participate in a free trial, or purchase a subscription grant CloPinz permission to reference the course as a participating or partner golf course. CloPinz may use:
For purposes including marketing materials, social media, promotional content, investor presentations, and advertising CloPinz adoption. CloPinz does not claim ownership of golf course trademarks or intellectual property.
Participating golf courses and tournament organizers operate independently from CloPinz. Golf courses are not employees, partners, agents, or representatives of CloPinz. CloPinz is not responsible for course operations, safety conditions, or contest administration performed by golf course staff.
Downloading or using the Services constitutes voluntary participation in contests facilitated through CloPinz.
To the fullest extent permitted by law, users agree to release, waive, and hold harmless CloPinz, JosJov Inc., participating golf courses, golf course owners and operators, tournament directors, contest organizers, sponsors, affiliates, and partners from any and all claims, damages, liabilities, costs, or expenses arising from:
The Services rely on GPS signals, device sensors, camera functionality, internet connectivity, and operating system permissions. Performance may vary depending on device capabilities, signal strength, and environmental conditions. Service interruptions, delays, or inaccuracies may occur.
CloPinz does not guarantee uninterrupted or error-free operation of the Services. Maintenance, technical failures, or external factors may temporarily limit service availability.
All software, code, trademarks, branding, graphics, and technology associated with the Services are owned by CloPinz or its licensors. Users may not copy, reverse engineer, modify, or reproduce the platform without permission.
You agree to indemnify and hold harmless CloPinz and its affiliates from claims arising from:
The Services are provided "as is" and "as available" without warranties of any kind.
To the maximum extent permitted by law, CloPinz shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services.
Any dispute arising from these Terms shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules. Seat of arbitration: California, USA. Class actions are waived to the fullest extent permitted by law.
These Terms are governed by the laws of the State of California.
CloPinz may suspend or terminate accounts for violations of these Terms.
CloPinz may modify these Terms periodically. Continued use of the Services constitutes acceptance of updated Terms.
